Terms of Use
1. Introduction
This Platform is operated by the African Venture Philanthropy Alliance (“AVPA”, “we”, “us”). By accessing, registering on, or using the Platform, you confirm that you have read, understood, and agree to be bound by these Terms of Use and the Data Protection provisions set out below. If you do not agree, you must not use the Platform.
2. Purpose and Nature of the Platform
The Platform is intended to facilitate the listing and sharing of impact-focused investment opportunities and engagement among social investors, social enterprises, and ecosystem actors. AVPA:
- Does not provide investment, legal, financial, or tax advice;
- Does not verify, endorse, or guarantee any deal, organisation, or information shared on the Platform; and
- Is not a party to any transaction, agreement, or relationship formed between users.
All decisions and engagements are undertaken at users’ sole discretion and risk.
3. User Obligations
Users agree to:
- Provide information that is accurate, complete, and not misleading;
- Use the Platform lawfully, ethically, and in good faith;
- Respect the confidentiality of non-public or sensitive information accessed through the Platform.
AVPA reserves the right to suspend or terminate access where a user’s conduct or information poses legal, reputational, or operational risk.
4. Content and Intellectual Property
All Platform content is protected by applicable intellectual property laws. Users retain ownership of content they submit but grant AVPA a non-exclusive, royalty-free licence to host, display, and use such content for Platform-related purposes. AVPA may remove content that breaches these Terms or applicable law.
5. Third-Party Links and Services
The Platform may contain links to third-party websites or services not operated by AVPA. AVPA is not responsible for the content, accuracy, security, or privacy practices of such third parties. Access is at users’ own risk.
6. Limitation of Liability
To the fullest extent permitted by law, AVPA shall not be liable for any loss, damage, or claim arising from use of or reliance on Platform content; deal listings or representations made by users; or interactions or transactions between users.
7. Governing Law and Updates
These Terms are governed by applicable laws relevant to AVPA’s operations, subject to mandatory data protection regulations. AVPA may update these Terms from time to time. Continued use of the Platform constitutes acceptance of any updates.
Data Protection Policy
8. Commitment to Data Protection
AVPA is committed to handling personal and organisational data responsibly and in accordance with applicable data protection laws and recognised international standards. This Policy explains how data is collected, used, stored, and shared.
9. Personal Data
“Personal Data” refers to any information relating to an identified or identifiable individual. The type of Personal Data collected depends on how you interact with the Platform and may include name, contact details, role, and organisation; deal-related or organisational information; platform usage and communication data.
10. Collection and Use of Data
AVPA may collect data when you:
- Register on the Platform;
- Submit deal or organisational information;
- Participate in events, programmes, or surveys;
- Communicate with AVPA or use Platform features.
Data is used to:
- Operate and administer the Platform;
- Facilitate deal discovery and ecosystem engagement;
- Manage user accounts and communications;
- Organise events and initiatives;
- Comply with legal and regulatory obligations.
AVPA will not use Personal Data for purposes beyond those disclosed, except where permitted by law.
Any document or information submitted by users in connection with registration or access to the Platform is collected solely for the purpose of assessing eligibility, administering access, and operating the Platform. AVPA does not undertake to rely on previously submitted materials and may request the same, similar, updated, or additional information at any time where necessary for verification, compliance, participation in other AVPA initiatives, or related operational purposes, subject always to applicable data protection laws.
11. Data Disclosure
Data may be shared with other Platform users, where relevant to deal listings or engagement; trusted service providers supporting Platform operations; ecosystem partners for legitimate collaboration; regulatory or governmental authorities where required by law. AVPA does not sell Personal Data.
12. Data Storage and Security
Personal Data may be stored on secure servers, including third-party infrastructure, and may be processed across borders where appropriate safeguards are in place. AVPA implements reasonable technical and organisational measures to protect data against unauthorised access, loss, or misuse.
13 Cookies and Tracking
The Platform may use cookies or similar technologies to improve functionality and user experience. Users may manage cookie settings through their browser preferences.
14. Data Accuracy and User Rights
Users are responsible for ensuring that Personal Data provided is accurate and up to date. Subject to applicable law, users may request access to, correction of, or deletion of their Personal Data, or withdraw consent to certain processing activities.
